VunOne, Inc. ("we," "us," or "our") provides the website Achiv.com (the "Platform" or "Service"). By creating an account or accessing the Platform, you agree to be bound by these Terms and Conditions ("Terms").

If you do not agree to these Terms, do not use Achiv.com.

1. Eligibility and Accounts

  • Age Requirement: You must be at least 13 years old to use the Platform.
  • Account Security: You are responsible for maintaining the confidentiality of your login credentials (via Google, GitHub, etc.). You are fully responsible for all activities that occur under your account.
  • Business Use: If you are using the Service on behalf of a company or entity, you represent that you have the authority to bind that entity to these Terms.

2. Credits and Usage

Achiv.com operates on a credit-based system. Each research operation (lead discovery, ICP generation, social media scanning) consumes credits.

  • Credit Allocation: Subscribers receive a monthly credit allotment based on their plan. Free users operate on a pay-as-you-go basis. Additional credits can be purchased at posted rates.
  • No Monetary Value: Credits are a limited, revocable license to use features of the Platform. They have no monetary value, are not a cryptocurrency, and cannot be redeemed for cash, legal tender, or currency of any kind.
  • No Transfers: You may not sell, trade, or transfer credits to other users or third parties.
  • Expiration: Unused monthly credits do not roll over to the next billing cycle unless otherwise specified in your plan terms.
  • Revocation: We reserve the right to revoke credits, adjust credit pricing, or modify credit consumption rates at any time. Violation of these Terms may result in forfeiture of remaining credits.

3. Your Data and AI Processing

You retain ownership of the information you provide to the Service, including product URLs, product descriptions, Ideal Customer Profile (ICP) configurations, and research parameters.

  • License Grant: You grant VunOne, Inc. a worldwide, non-exclusive, royalty-free license to use, process, and store your inputs in connection with delivering the Service — specifically to analyze your product, generate ICPs, discover and qualify leads, and deliver research results.
  • AI Processing: You acknowledge and consent that your product information (URLs, descriptions, ICP configurations) will be processed by third-party AI providers (as described in our Privacy Policy) for lead discovery, relevance scoring, pain point extraction, and competitor analysis. We do not use your data to train AI models.
  • Research Output: Lead discovery results, relevance scores, and analytical insights generated by the Service are provided for your use within the platform. You may not resell, redistribute, or sublicense raw lead data or research outputs to third parties.
  • Account Deletion: If you delete your account, your stored data (product URLs, ICP configurations, research results) will be deleted in accordance with our data retention practices described in the Privacy Policy.

4. Subscriptions and Payments

  • Plans: The Service offers Free (pay-as-you-go), Pro, Pro Max, and Enterprise subscription tiers. Features and credit allotments vary by plan. Current pricing and feature details are available on Achiv.com.
  • Billing: Payments are processed by our third-party provider, Stripe.
  • No Refunds: ALL PAYMENTS ARE NON-REFUNDABLE. We do not provide refunds or credits for any partial subscription periods or unused services.
  • Cancellation: You may cancel your subscription at any time through your account settings. Access will continue until the end of your current billing cycle.

5. Prohibited Conduct

Achiv is built for ethical outreach. The following result in immediate suspension or banning:

  • Spam and Unsolicited Outreach: Using leads discovered through the Service to send unsolicited bulk messages, automated DMs, or any form of spam. You are responsible for engaging ethically and in compliance with applicable anti-spam laws (CAN-SPAM, GDPR, etc.).
  • Data Resale: Reselling, redistributing, or commercially exploiting lead data, research outputs, or any information obtained through the Service.
  • Scraping and Automation: Using bots, scripts, or automated tools to scrape, extract, or bulk-download data from the Platform beyond normal use of the Service.
  • Circumvention: Attempting to bypass credit limits, usage restrictions, or rate limits through any technical means.
  • Misrepresentation: Providing false product information or URLs to manipulate research results.
  • NSFW Content: Strict prohibition of nudity, sexual content, or graphic violence in any user-provided content.
  • Hate Speech & Harassment: Zero tolerance for hate speech, bullying, or harassment in any interactions facilitated by the Service.

6. AI-Powered Features

  • AI-Driven Lead Discovery: You acknowledge that Achiv.com uses artificial intelligence to analyze your product, generate Ideal Customer Profiles, discover relevant conversations across social platforms, and score leads for relevance.
  • No Guarantee of Accuracy: AI-generated results (ICPs, relevance scores, pain point analysis, competitor mentions) are provided as informational tools. We do not guarantee the accuracy, completeness, or reliability of any AI-generated output. You should independently verify lead quality before engaging.
  • Continuous Improvement: AI models and scoring algorithms may change at any time to improve the quality of results. Such changes may affect how leads are scored, filtered, or presented.

7. Disclaimers

  • "As Is" Service: The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. We do not guarantee that the Service will be uninterrupted or error-free.
  • No Guarantee of Success: We do not guarantee that using Achiv.com for lead discovery will result in customer acquisition, revenue, or business success. Lead quality and conversion depend on many factors outside our control.
  • Third-Party Content: Leads discovered through the Service are based on publicly available third-party content. We are not responsible for the accuracy of information posted by third parties on social media platforms, nor for the outcome of any interactions you initiate based on lead data.

8. Limitation of Liability

To the maximum extent permitted by law, VunOne, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
